The following terms and conditions apply to all transactions carried out through the Nicola Lawrence website. Please ensure that you read the following carefully as it is deemed that by accessing this website and/or placing an order you have accepted these terms and conditions.
Many of the brands held by Nicola Lawrence are subject to licensing agreements and are not able to be shipped internationally. Please contact firstname.lastname@example.org for further information. Most of the brands are able to be shipped to New Zealand however contact should be made through the website in this circumstance. Most cushions and lampshades may be shipped to any destination. Please contact email@example.com for further information.
Samples are available for fabrics and wallpapers and may be ordered from the website with a limit of SIX samples per order. If you have a specific project which requires more than six samples please email firstname.lastname@example.org . Pricing for samples differs across each of the suppliers however the price includes postage. Samples vary in size according to the supplier or design house. As a guide the lead time shown for delivery of fabric/wallpaper will also apply to samples however it may take longer when sampling is not held in Australia. Nicola Lawrence will acquire all requested samples and send in the one delivery.
COLOUR - TEXTILES/WALLPAPERS
Every attempt is made to ensure the colours displayed on our website are true and accurate, however colour variations are inevitable due to monitor settings and lighting conditions. Due to the artisanal printing processes of most of these products, slight colour variations may occur between samples and batches. If you need to match a colour exactly please request, by email, a ‘stock cutting’ of the current batch. The printing process may also result in slight ‘discrepancies’ in the printing. This is considered the nature of the product and that it adds to its individuality and beauty and this consideration is deemed to be understood by the purchaser as indicated by acceptance of these terms.
LES INDIENNES FABRICS
Les Indiennes textiles are 100% preshrunk cotton, made entirely by hand using India’s traditional kalamkari process. Due to the hand-crafted nature of the products, exact repeat or pattern alignment cannot be guaranteed and slight imperfections will exist. Smudges and spots are often present, and because only natural dyes are used, slight bleeding of color may occur as well as fading. Dye lots can have major variations and will not match from order to order; therefore, customers must order initially a sufficient quantity of fabric to complete a job. Customers should follow the Care instructions detailed on the website. These considerations are deemed to be understood by the purcase as indicated by the acceptance of these terms upon purchase.
It is important that, prior to ordering, you ensure the suitability of the product for your intended purpose or use. Use and Care details are listed as advised by the suppliers. We are unable to accept any liability arising in respect of any loss, damage or deterioration in the condition of any goods sold caused by usage, shrinkage, cleaning processes, atmospheric conditions or assembly, make-up, installation or general application.
All due care and attention is given to ensuring that all product information displayed on our website is correct and up to date, including pricing and technical information. We are reliant on receiving timely and accurate information from our Suppliers and cannot be held responsible for any inaccuracies. Please check the product information prior to ordering. We cannot be held responsible for pricing, typographical or other errors on our website.
Minimum Orders for individual fabrics and wallpapers are listed on the website and are determined by the supplier. Minimum orders are usually given in metres (for example, one metre, four metres) and thereafter in 50cm increments.
SMALL ORDER FEES
Small order fees are set by the suppliers and advised in the details on each product page. They will be applied at checkout.
Please note that many of our products, including in some instances, samples, are printed to order (printed once an order has been placed). The approximate lead times for fabrics and wallpapers once order has been placed, as advised by the suppliers, are listed in each product detail area however these times may vary depending on the stock levels at the time. All delivery times are approximate and we will not be held liable for any compensation as a result of any unexpected delays. Should there be a delay we will contact you by email as soon as we are advised by the supplier. Lead times for cushions will vary, depending on whether they are in stock (two weeks). If the fabric requires printing and the cushion to be made, the lead time may be eight weeks.
Pricing is GST inclusive and is in Australian Dollars. Payment may be made by Paypal (which includes Visa and Mastercard and EFT) or by credit card for those who are not registered with Paypal. Payment will be deducted immediately on order. Nicola Lawrence will place product orders upon receipt of monies. Orders resulting from email, invoice or quote allow for payments by Direct Bank Transfer, cheque or money order (made payable to Nicola Lawrence) however product orders will not be placed until these funds are cleared. Please check that the email address you provide to us is correct and that both your billing and delivery addresses are completed fully.
Your order becomes binding as soon as we have accepted it. Our acceptance of your order is conditional on the availability of the products you have ordered. If any of the products you are ordered are unavailable or should events occur beyond our reasonable control, we reserve the right to cancel your order and refund your payment for that order in full. In such circumstances we will let you know as soon as possible.
CANCELLATION OF ORDER
Due to the specialist nature of products within this website you are unable to cancel your order once your order has been accepted by us.
You warrant that: The personal information which you are required to provide when you register as a customer is true, accurate and complete in all aspects: you will notify us immediately of any changes to the personal information by contacting our customer service staff by email. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
All goods are subject to availability. Should a fabric or wallpaper be out of stock or delayed in printing we will contact you as soon as we are advised by the supplier. Delivery of products shipped from overseas may take one to two weeks longer than the lead time shown. We do not accept responsibility for transit, customs or other delays outside our control. Orders within Australia are delivered by Australia Post or TNT to your nominated business or residential address and in many circumstances to expedite delivery, will be delivered directly from the supplier. Please include permission and information as to where items may be left by the carrier should nobody be available to accept them. Extra fees will be charged if the carrier is not able to deliver in the first instance. There is a flat rate of $30 delivery, packaging and handling fee per order for all fabric and wallpaper delivery within Australia. Delivery rates for decorative pieces will vary. Delivery of samples is by Australia Post and the cost is included in sample pricing.
ACCEPTANCE OF DELIVERY
Please ensure deliveries are inspected for obvious transit damage. Claims for damage in transit must be supported by your conditional acceptance of delivery receipt from the courier noting the damage which has occurred. Where deliveries are made to third parties, it is your responsibility to check that the order is supplied to your satisfaction. We cannot accept claims for making, installation or replacement charges where correct supply has not been verified. Please check all items on arrival and immediately report any damage or short deliveries in writing to email@example.com.
These are speciality products. Variations in colour and texture may occur within a single piece and also between print runs due to the irregular nature of yarns. This is the character and nature of the fabrics.
A cut length of fabric or wallpaper is classed as a bespoke item as that specific length has been cut especially for you. Therefore, once you have placed an order for fabric or wallpaper you are unable to cancel the order for any reason, including that the fabric or wallpaper will not suit the purpose for which you intended it, a change of mind, or for extra fabric/wallpaper which was ordered by not used.
PLEASE NOTE: Please check all wallpaper and fabric prior to cutting. No refunds can be given once the goods have been cut, treated or altered in any way.
FAULTS/INCORRECT SUPPLY: All goods must be checked upon receipt. Please contact us within three (3) days of receipt if you have any queries about the products you have received. We place the highest importance on supplying all orders correctly. If the product is supplied incorrectly or if it is of unacceptable quality, we will either replace it with the correct item or refund the cost of your order including costs associated with returning to us. Refunds/replacements cannot be arranged until we have received and inspected the returned order.
NO RETURNS allowed after fabric or wallpaper is cut or treated in any way.
MADE TO MEASURE PRODUCTS
The products you order will be made specifically to your order in accordance with the instructions and specifications you have given us at the time of your order.
It is your responsibility to check all details and aspects of your order are correct and suitable for your requirements, including: measurements, dimensions, product features, fabric/wallpaper and colour choice.
Nicola Lawrence recognises the importance of your privacy. We will only seek information that is required to conduct our business. Your personal information is collected to enable us to process orders, deliver goods and/or to inform you of special promotions or news. Nicola Lawrence will not disclose, sell or trade your personal information to any third parties, other than third party suppliers in the delivery of goods you have agreed to, or when legally required.
You agree fully to indemnify, defend and hold us, our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this website or the use by any other person accessing the website using your account and/or your personal information.
We reserve the right to: modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website.
All rights, including copyright, in the contact of the Nicola Lawrence website are owned or controlled for these purposes by Nicola Lawrence. In accessing this website you agree that you may only download the content for your own personal non-commercial use. Except where expressly stated otherwise, you are not permitted to copy, broadcast, download, store, transmit, show or play in public, create derivative works of such material and content, adapt or change in any way the content of these web pages for any other purpose whatsoever without the prior written permission of Nicola Lawrence.
Please take note of the hanging instructions which will be included with your order as provided by the designer/supplier. Some of the wallpapers will be untrimmed so it is strongly recommended that the papers be installed by a professional wallpaper hanger. Nicola Lawrence will not be held responsible for errors from papers installed otherwise.
